1. About These Terms

These Terms of Service ("Terms") govern your access to and use of PlantID, a mobile application developed and operated by an individual developer under the developer name Lowenergy Labs.

By downloading, accessing or using PlantID, you agree to these Terms.

If you do not agree to these Terms, you should not use PlantID.

2. Age Requirement

PlantID is intended only for users who are 18 years of age or older.

By using PlantID, you represent that you are at least 18 years old.

PlantID is not designed, directed or marketed for use by individuals under the age of 18.

3. What PlantID Provides

PlantID is an AI-assisted application designed to provide plant-related information and tools.

Depending on the version and features available to you, PlantID may provide:

• plant identification from photographs;
• plant health and condition analysis;
• AI-generated plant diagnosis;
• plant-care information;
• translation of plant information;
• identification and diagnosis history;
• favourites and personal plant collections;
• reminders and plant-care utilities.

Some features require an internet connection and access to third-party services.

Features may change, be added or be removed as PlantID develops.

4. Artificial Intelligence

PlantID uses artificial intelligence, including third-party AI services such as the Google Gemini API, to generate plant identification, diagnosis, translation and related information.

Artificial intelligence is probabilistic and can make mistakes.

PlantID therefore does not guarantee that any identification, diagnosis, recommendation, classification or other AI-generated result is accurate, complete, current or appropriate for your particular situation.

Results may vary depending on factors including:

• image quality;
• lighting;
• plant condition;
• visible plant features;
• similarity between species;
• information available to the AI model;
• technical limitations;
• changes to third-party AI systems.

You should use PlantID results as informational guidance rather than as verified professional conclusions.

5. Plant Identification Is Not Guaranteed

Plant species may be visually similar, particularly when photographs do not contain flowers, fruit, leaves or other distinguishing characteristics.

PlantID may incorrectly identify:

• a species;
• a genus;
• a plant family;
• a cultivar;
• a disease;
• a pest;
• a plant condition.

You should independently verify an identification whenever accuracy is important.

6. Plant Diagnosis Is Informational Only

PlantID's diagnosis functionality is intended to provide general informational guidance about possible plant conditions.

It is not a substitute for professional advice from a qualified botanist, horticulturist, agronomist, plant pathologist, agricultural professional or other appropriately qualified specialist.

PlantID cannot examine environmental conditions, soil, roots, pests, diseases or other factors with the same reliability as a physical professional assessment.

Do not make significant agricultural, commercial or environmental decisions solely on the basis of a PlantID diagnosis.

7. Toxicity, Edibility and Safety

Never rely solely on PlantID to determine whether a plant, fruit, seed, mushroom-like growth, flower, leaf or other biological material is safe to eat, drink, touch, handle or administer to a person or animal.

PlantID does not guarantee the accuracy of information relating to:

• toxicity;
• edibility;
• allergens;
• medicinal properties;
• psychoactive effects;
• skin irritation;
• animal safety;
• child safety;
• food safety.

You must independently verify such information through an appropriate authoritative source or qualified professional.

Do not consume or administer any plant or plant-derived substance solely because PlantID identifies it as edible, safe or non-toxic.

If you believe a person or animal may have been exposed to a poisonous or harmful substance, contact an appropriate medical professional, veterinary professional, poison-control service or emergency service immediately.

Do not delay professional assistance based on information provided by PlantID.

8. No Medical or Veterinary Advice

PlantID does not provide medical, veterinary, toxicological or pharmaceutical advice.

Information provided through PlantID must not be used to diagnose, prevent, treat or manage a human or animal medical condition.

Always consult an appropriately qualified professional where human or animal health may be affected.

9. User Photographs and Content

You retain ownership of photographs and other content that you submit through PlantID.

By submitting an image for identification, diagnosis or another requested operation, you grant Lowenergy Labs a limited, non-exclusive permission to process and transmit that image only as reasonably necessary to provide the requested PlantID service.

This may include transmission to third-party infrastructure and AI providers as described in the PlantID Privacy Policy.

You should only submit content that you have the legal right to use.

You should avoid submitting photographs containing:

• identifiable people;
• identity documents;
• financial information;
• confidential information;
• sensitive personal information;
• information unrelated to the requested PlantID function.

PlantID is intended for plant-related images.

10. Privacy

Your use of PlantID is also governed by the PlantID Privacy Policy, available at:

https://lowenergylabs.com/privacy

The Privacy Policy explains how PlantID processes photographs, anonymous identifiers, technical records and other information.

11. Free Access and Usage Limits

PlantID may provide certain AI functionality without payment.

Free access is subject to usage limits.

The current planned Free allowance is:

10 plant identifications per month
1 plant diagnosis per month

New users may also receive an introductory allowance or other promotional access where displayed in the app.

Usage allowances do not represent stored monetary value and cannot be transferred, exchanged for money or sold.

Unused free allowances may expire and do not necessarily carry over to future usage periods.

Lowenergy Labs may reasonably modify free limits in future versions where necessary for service sustainability, technical capacity, AI-provider costs, abuse prevention or product development.

Any material change will be communicated where required.

12. PlantID Premium

PlantID may offer an optional paid subscription currently referred to as PlantID Premium.

Premium provides increased access to AI-powered functionality and other Premium features made available in the app.

Premium is not an unlimited-use service.

To protect the service against abuse and unreasonable automated or excessive usage, Premium remains subject to fair-use technical limits.

The current planned Premium technical allowances are:

Up to 200 plant identifications per monthly usage period
Up to 50 plant diagnoses per monthly usage period

These limits are designed to be substantially higher than normal individual usage while protecting the sustainability and availability of the service.

Lowenergy Labs may reasonably adjust technical limits if required because of:

• abuse;
• automated usage;
• third-party AI restrictions;
• infrastructure limitations;
• substantial changes in operating costs;
• legal requirements;
• service-security concerns.

PlantID will not market Premium as providing unlimited AI usage when technical limits apply.

13. Subscription Plans and Prices

The planned PlantID Premium subscription options are:

Monthly: €3.99
Annual: €29.99

The actual price presented by the applicable app marketplace at the time of purchase is the controlling price.

Prices may differ according to:

• country;
• currency;
• taxes;
• marketplace pricing rules;
• exchange rates;
• promotional offers.

Where required, applicable taxes are included or added according to the rules of the marketplace processing the transaction.

Lowenergy Labs may change subscription prices in the future.

Existing subscribers will receive any notice required by the applicable marketplace or applicable law before a price change takes effect.

14. Payment Processing

PlantID subscriptions are purchased through the applicable application marketplace, such as Google Play, where available.

Lowenergy Labs does not directly collect or store your full payment-card details for marketplace purchases.

Payments are subject to the terms, billing rules and payment policies of the marketplace through which the subscription was purchased.

15. Automatic Renewal

PlantID Premium subscriptions may automatically renew at the end of each billing period unless cancelled before the applicable renewal date.

The applicable marketplace will charge the payment method associated with your marketplace account according to the subscription terms displayed during purchase.

You are responsible for managing your subscription through the marketplace account used to purchase it.

16. Cancellation

You may cancel the automatic renewal of your PlantID Premium subscription through the marketplace where you purchased it.

Cancellation normally prevents the next renewal.

Cancelling a subscription does not normally terminate Premium access immediately.

Unless otherwise required by law or marketplace policy, Premium access remains available until the end of the billing period already paid for.

Deleting or uninstalling PlantID does not automatically cancel an active subscription.

When a paid subscription expires, your PlantID access may return to the Free plan and its applicable usage limits.

Your locally stored plant history, photographs and favourites will not be intentionally deleted merely because a Premium subscription ends.

17. Restore Purchases

Where supported by the applicable marketplace, PlantID will provide a mechanism to restore eligible purchases or subscription entitlements.

Restoration requires use of the marketplace account associated with the original purchase and remains subject to the marketplace's records and policies.

18. Refunds and Consumer Withdrawal Rights

Payments, cancellations and refund eligibility may be subject to the policies of the marketplace through which the purchase was made, including Google Play where applicable.

Nothing in these Terms limits any refund, cancellation, withdrawal, conformity or other consumer right that cannot legally be excluded.

Consumers in the European Economic Area may have statutory rights relating to contracts for digital content or digital services.

Depending on the nature of the purchased digital product or service and the applicable marketplace process, you may be asked during checkout to request immediate performance or supply and, where legally applicable, acknowledge the effect that immediate supply may have on a statutory right of withdrawal.

Any such consent or acknowledgement is handled through the applicable purchase process and applies only to the extent permitted by law.

Where a refund is legally required, it will be handled in accordance with applicable law and the relevant marketplace rules.

19. Fair Use and Prohibited Uses

You must use PlantID only for lawful personal purposes and in accordance with these Terms.

You must not:

• circumvent or attempt to circumvent usage limits;
• create multiple identities or installations primarily to evade quotas;
• automate requests without authorisation;
• excessively load, scrape or probe PlantID services;
• attempt to obtain private API keys or credentials;
• interfere with PlantID infrastructure or security;
• reverse engineer PlantID except where such restriction is prohibited by applicable law;
• use PlantID to distribute malware or malicious content;
• use PlantID for unlawful activities;
• resell or commercially redistribute PlantID AI access without written permission;
• impersonate another person or misrepresent your entitlement to a subscription.

Lowenergy Labs may restrict access where reasonably necessary to protect PlantID, other users or third-party infrastructure from abuse, fraud or security threats.

20. Intellectual Property

PlantID, including its software, design, branding, interface, original text, logos and other proprietary materials, is owned by or licensed to Lowenergy Labs except where otherwise stated.

These Terms give you a personal, limited, revocable, non-exclusive and non-transferable right to use PlantID for its intended purpose.

They do not transfer ownership of PlantID or its intellectual property to you.

Third-party software, libraries, datasets, trademarks and services remain subject to their respective rights and licences.

21. Third-Party Services

PlantID depends on third-party services including infrastructure, artificial-intelligence providers and application marketplaces.

Lowenergy Labs does not control those services and cannot guarantee their continuous availability.

Changes, outages, restrictions or discontinuation of third-party services may affect PlantID functionality.

Where reasonably possible, Lowenergy Labs may modify PlantID to maintain functionality following third-party changes, but does not guarantee that every feature will always remain available.

22. Service Availability and Changes

PlantID is provided on an evolving basis.

We may:

• improve existing features;
• introduce new features;
• modify AI models or providers;
• change technical infrastructure;
• correct errors;
• change usage limits;
• discontinue features;
• temporarily suspend parts of the service for maintenance, security or technical reasons.

Where a material change affects a paid subscription, applicable consumer rights and marketplace obligations will remain unaffected.

We do not guarantee uninterrupted or error-free availability.

23. Suspension or Termination

Lowenergy Labs may suspend or restrict access to PlantID where reasonably necessary because of:

• serious or repeated violation of these Terms;
• fraudulent activity;
• attempted circumvention of usage limits;
• attacks against PlantID infrastructure;
• unlawful use;
• threats to service security;
• requirements imposed by law or a third-party platform.

Where reasonable and legally required, users will be given appropriate notice.

Nothing in this section removes mandatory consumer rights associated with a paid subscription.

24. Disclaimer of Warranties

To the fullest extent permitted by applicable law, PlantID is provided on an "as is" and "as available" basis.

Lowenergy Labs does not warrant that:

• PlantID will always be available;
• PlantID will be free from errors;
• every plant will be identifiable;
• AI results will always be accurate;
• diagnoses will always identify the actual cause of a plant condition;
• all information will always be complete or current.

Nothing in these Terms excludes warranties or legal guarantees that cannot be excluded under applicable consumer law.

25. Limitation of Liability

To the fullest extent permitted by applicable law, Lowenergy Labs will not be responsible for indirect, incidental or consequential loss arising solely from reliance on inaccurate or incomplete AI-generated information where such liability may legally be limited.

In particular, users are responsible for independently verifying information before making decisions involving:

• consumption of plants;
• toxicity;
• medical or veterinary safety;
• pesticides or chemical treatments;
• valuable plants or crops;
• significant financial or agricultural decisions.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

In particular, these Terms do not exclude liability that cannot lawfully be excluded for fraud, intentional misconduct, personal injury or other matters protected by mandatory law.

Your mandatory statutory consumer rights remain unaffected.

26. Indemnity

To the extent permitted by applicable law, you are responsible for losses or claims resulting from your intentional unlawful use of PlantID, violation of third-party rights or deliberate misuse of PlantID infrastructure.

This section does not apply where such liability cannot lawfully be imposed on a consumer.

27. Changes to These Terms

We may update these Terms to reflect:

• changes to PlantID;
• new features;
• subscription changes;
• changes to third-party services;
• security requirements;
• legal or regulatory requirements.

The current version will be published at:

https://lowenergylabs.com/terms

The "Last updated" date will indicate when the Terms were most recently modified.

For material changes, additional notice will be provided where required by applicable law.

Continued use after an applicable change takes effect constitutes acceptance only to the extent permitted by law.

28. Governing Law and Consumer Rights

These Terms are governed by the laws of France, without regard to conflict-of-law principles, except where mandatory law provides otherwise.

If you are a consumer, this choice of French law does not deprive you of mandatory consumer protections that apply under the laws of the country where you habitually reside.

Nothing in these Terms restricts any right to bring a claim before a court or authority that has jurisdiction under mandatory applicable law.

Where permitted by law, disputes that cannot be resolved informally will be subject to the competent courts determined under applicable French and European law.

29. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

30. Entire Agreement

These Terms, together with the PlantID Privacy Policy and any mandatory marketplace terms applicable to a purchase, constitute the agreement governing your use of PlantID.

Where marketplace terms govern billing, payment, cancellation or refund procedures, those marketplace rules apply to the relevant transaction.

Mandatory consumer law prevails over any conflicting contractual provision where required.
